Ground Rules: Challenges to the Implementation of Security of Land Title in Urban India

Implementation of guarantee to land title is one of the important reform elements mandated under JNNURM. A policy seminar at IndiaUSP 2007, supported by the MoUD was the first ever detailed debate on this issue in the country. Experts from within India and abroad examined the wide basket of issues, institutional and legal frameworks, initiatives within India and international experiences, and then identified the challenges and a framework for introduction of guarantee to land title. This report is the formal output of the MoUD-IndiaUSP 2007 policy programme, which also incorporates research before and after the dialogue.

The report provides a brief background to the history of land ownership of pre-colonial, colonial and post-Independence times. It also provides a glimpse into the land reform initiatives of different states and a global snapshot of the elements adopted in land title systems.

The emergence of state sponsored titling systems in different parts of the world, are briefly described in boxed sections in the document. The case studies have been organised under five headings: scope of the title; relevant statutes on titles; the guarantee process; the title management system; and the transition process. These case studies provide the readers of this report – significantly state governments and policy makers – a menu-bar of options to compare and aid them in making their choices. The annexure titled “Questions to Consider” is also organised along these five considerations and provides a tool to probe the various aspects of title considerations. Finally, the report attempts to summarise the challenges involved for states in implementing urban land title, and provides a broad-brush guidelines and suggestions.
